Terms of service
Purpose
These Terms govern the rights, obligations, and responsibilities of FORTY COMPANY CO., LTD. (the “Company”) and users in connection with the sale of products and related services provided through the Company’s online grocery platform (the “Mall”).
Definitions
“Mall” means the online store operated by the Company to provide products or services. “User” means any member or non-member using the Mall, and “Member” means a person registered for continued use of the services.
Posting and Amendment of Terms
The Company will make these Terms and legally required business information readily accessible on the Mall. The Company may amend these Terms within the limits permitted by law and will provide advance notice of the effective date and material changes.
Services
The Company provides product information, order processing, payment, delivery, exchanges, returns, refunds, customer support, and related services. Products or services may change due to stock shortages, supply interruptions, or other unavoidable circumstances.
Membership and Account Management
Users may register as members according to the Company’s procedures. Members must provide accurate information and safeguard their account credentials. Identity theft, false registration, or abusive use may result in restrictions.
Orders and Formation of Contract
Users place orders by selecting products, confirming order details, entering delivery information, and completing payment. A purchase contract is formed when the order and payment are confirmed. In cases such as stock errors or obvious pricing errors, the Company may notify the user and cancel/refund the transaction.
Payment
Users may use payment methods made available on the Mall. Separate terms of payment processors or financial institutions may apply.
Delivery
The Company dispatches products after payment confirmation. Shipping fees and estimated delivery times are displayed during checkout or on product pages. Delivery may be delayed by natural disasters, carrier issues, holidays, remote locations, supplier issues, or similar circumstances.
Food Characteristics and Storage
Chilled, frozen, and fresh foods must be stored immediately according to the product instructions. Exchanges or refunds may be restricted where deterioration results from delayed receipt, incorrect address information, or improper storage by the user.
Exchanges, Returns and Refunds
Exchanges, returns, and refunds are governed by the Refund Policy below and applicable laws.
Company Obligations
The Company will comply with applicable laws, make reasonable efforts to provide stable services and protect personal information, and maintain a customer support channel for legitimate inquiries and complaints.
User Obligations and Prohibited Conduct
Users must not submit false information, misuse another person’s information, infringe intellectual property rights, disrupt the service, make fraudulent payments or abnormal orders, or otherwise violate applicable laws.
Intellectual Property
Copyright and other intellectual property rights in content produced for the Mall belong to the Company or the applicable lawful rights holder.
Limitation of Liability
Where services cannot be provided due to circumstances beyond the Company’s reasonable control, such as natural disasters or telecommunications failures, liability may be limited to the extent permitted by law. Loss caused by the Company’s intent or negligence will be handled under applicable law.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Korea. The Company and users will attempt to resolve disputes amicably, and jurisdiction for litigation will be determined under applicable law.
These Terms are effective as of August 19, 2026.
